Extract from the Order of the Ministry of Economy, Commerce, Technological Innovation, Tourism and Development number 2023000170 dated 07/31/2023, which approves the CALL FOR THE TRADE MODERNIZATION PROGRAM TECHNOLOGICAL FUND IN THE MARC

Official description of the call

The aid in this call is covered by the Recovery, Transformation and Resilience Mechanism of the European Union, established by Council Regulation (EU) 2020/2094, of December 14, 2020, establishing a European Union Recovery Instrument to support recovery after the COVID-19 crisis, and regulated according to Regulation (EU) 2021/241 of the European Parliament and of the Council of February 12, 2021. First. Beneficiaries. Small and medium-sized companies in the retail commercial sector may be beneficiaries of the aid from this call; small and medium-sized retail businesses (SMEs), whether natural or legal persons, and civil companies with a commercial nature, which must necessarily own and carry out their commercial activity in a permanent physical establishment. The activity carried out in the establishment must fall within one of the following headings of the Economic Activities Tax: 641, 642, 643, 644, 645, 647.1, 647.2, 647.3, 647.4, 651, 652.2, 652.3, 652.4, 653, 654.1, 657, 659, 661.3 and 662.2. SME is understood as the provisions of Commission Regulation (EC) No 1407/2013 of 18 December 2013, relating to the application of articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid (published in OJEU L 352/1, of 24 December 2013), modified by Regulation (EU) 2020/972 of the Commission, of July 2, 2020, (published in OJEU L215/3, of July 7, 2020) and in the Commission Recommendation of May 6, 2003 on the definition of micro, small and medium-sized enterprises. Persons or entities that are subject to any of the causes of prohibition referred to in article 13, section 2, of Law 38/2003, of November 17, General of Subsidies and article 27 of RD 887/2006, of July 21, which approves the Regulation of Law 38/2003, of November 17, General of Subsidies, may not obtain the status of beneficiary. Subsidies, as well as any other provided for in the applicable regulations regarding subsidies, and that apply to the subjects defined as beneficiaries. Those who have been subject to a final administrative sanction or a final conviction for actions or omissions considered discriminatory by current legislation based on gender may not obtain the status of beneficiaries. Those who fail to comply with the requirements of environmental legislation in relation to the treatment of the waste that they produce, if applicable, will not be able to obtain the status of beneficiaries. Those who have been sanctioned by the competent labor authority, through a final administrative resolution, with the accessory sanctions of exclusion from access to aid and benefits derived from the application of employment programs will not be able to obtain the status of beneficiaries. Those who are not up to date in compliance with tax obligations, both with the State Treasury and with that of the Administration of the Autonomous City of Melilla, and with Social Security, as well as those who have any debt pending payment with the Autonomous City of Melilla, will not be able to obtain the status of beneficiary. Second. Object. The purpose of this call is to establish the granting of public aid under a competitive competition regime aimed at supporting and promoting competitiveness and modernization, through the digital and sustainable transformation of small and medium-sized commercial companies in the territorial area of ​​the Autonomous City of Melilla. The objectives pursued by the different lines of subsidy are the following: a) Promote the development of plans and projects with technological, innovative and sustainable content that affect the management of commercial activity and its business model. b) Guarantee the adaptation of these plans and projects to new consumer habits, sales modalities, positioning and distribution. Third. Regulatory bases. The regulatory bases of this call are approved by agreement of the Government Council dated December 22, 2022, regarding the approval of the REGULATORY BASES OF THE AID LINE FOR THE TRADE MODERNIZATION PROGRAM TECHNOLOGICAL FUND WITHIN THE FRAMEWORK OF THE RECOVERY, TRANSFORMATION AND RESILIENCE PLAN, FOR THE CALL IN THE YEAR 2022 And 2023.
