CALL THROUGH EARLY PROCESSING SPECIFIC BASIS OF SOCIAL BENEFITS OF ECONOMIC ECONOMIC NATURE OF EMERGENCY, FOR THE YEAR 2024 APPLICABLE REGULATIONS The bases of social aid are framed in the basic municipal competence established in the law of Bases of Local Regime, article 25.2.e), of immediate attention to people at risk or social exclusion. Likewise, it is also derived from European, state and regional regulations on economic benefits and in particular Law 13/2006 of July 27, on social benefits of an economic nature and Law 12/2008 of October 11, on social services. Law 13/2006 of July 27 on social benefits of an economic nature, in its preamble establishes that its purpose is to determine the legal regime of specific benefits and basic rules to exercise competition rights for benefits that are established with budgetary limits. The third section of chapter 4 of this law regulates social emergency economic benefits, in which the principle of local autonomy has been taken into account. Thus, this law establishes that the creation of these benefits corresponds to local entities, although the law determines only the three basic ones, such as the purpose, benefits and assessment of emergency situations. Law 12/2007 of October 11 on social services, in its article 17, establishes as one of the functions of basic social services the management of emergency social benefits and the management of the processing of municipal and regional economic benefits and the others that are attributed to it. Likewise, in article 22, monetary contributions are defined as economic benefits, which are intended to address certain situations of need in which people find themselves who do not have sufficient economic resources to cope with them and are not in a position to obtain them or receive them from other fronts. According to the same article, economic benefits can be granted as a subjective right, right of competition or social urgency. The Municipal Ordinance regulating social emergency aid, approved by Plenary on January 18, 2021, and published in the BOPT of March 2, 2021 number 2021 -01563, has been taken into account for the drafting of the 2024 social aid bases. In terms of procedure and compliance with the legal requirements that must guide the actions of the basic territorial administration, the social aid bases are subsidiary to Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. 1.- Purpose of the bases. The purpose of these bases are, in accordance with the provisions of the General Regulation of Subsidies approved by the Bellvei City Council on 10-19-2017 and what is expressed in Law 13/2006 of July 27, on economic social benefits of the Generalitat of Catalonia, the monetary contributions made by the Bellvei City Council that have the purpose of addressing certain situations of need in which people who do not have financial resources find themselves. sufficient to cope - they are not in a position to obtain them or receive them from other sources. Individuals who process the corresponding application in accordance with point 3 of these bases and who meet the following conditions and requirements (duly accredited) may obtain the status of beneficiaries of the subsidies referred to in these bases: a. That the applicants have exhausted the possibilities of: - Obtaining help from other administrations. - Help from extended family. - Pay the debt in partial amounts. b. That applicants for these benefits request it in writing according to the standardized procedure and provide all the documentation and/or information required for their social and economic assessment. c.
