Presidency 2023/5175, of July 6, approving the Call under a non-competitive competition regime for the granting of subsidies for current expenses and investment, agri-food, livestock and fishing sectors (Plan Málaga III)

Official description of the call

Article 1.- Object and eligible expenses. 1. The purpose of the call is the granting, on a non-competitive basis, of the following lines of subsidies aimed at alleviating the economic damages caused by the energy crisis in the agri-food, livestock and fishing sector located in the province of Málaga (Plan Málaga III): 1. LINE 1. CURRENT EXPENDITURE ON GOODS AND SERVICES. 2. LINE 2. INVESTMENT EXPENSES. 2. The following will be considered eligible expenses: A) CURRENT EXPENSES: - In the case of applicant natural persons, contributions for contributions to the Special Social Security Regime for Self-Employed or Self-Employed Workers (including the Special System for Agricultural Self-Employed Workers) and the Special Social Security Regime for Seafarers. For companies, personnel expenses corresponding to the remuneration in kind to partners for the contribution of said quotas. - Production cost expenses, understood as the following: a) Food, feed, agricultural fertilizer, transportation and the amount paid for the purchase of oxygen necessary for aquaculture facilities. b) In the fishing sector, those related to bait, salt, ice, containers and packaging, supplies, gear, lubricants and costs of transporting fishing products from their landing place to the authorized point of sale. c) Agricultural work services (harvesting, plowing, mowing, packaging or similar). - Expenses for leasing or subletting real estate related to the economic activity carried out. B) INVESTMENT EXPENSES intended for modernization, automation and digitalization of productive activity or that imply improvement in productivity, understood as the following: - Machinery, tools, equipment and production processes. (Fungible goods are excluded). - Facilities and infrastructure. - Expenses for changing crops or irrigation methods. - Acquisition of transport elements (tractors, vans, trailers, delivery motorcycles or similar). 3. The execution period for eligible expenses will be between March 1, 2023 and March 31, 2024, therefore, eligible expenses incurred prior to the publication of the subsidy call will be permitted, provided that they have been executed within the indicated period. 4. The following expenses will not be eligible for subsidies: a) Financial expenses b) Taxes will be eligible expenses when the beneficiary of the subsidy actually pays them. In no case will VAT be considered eligible when it is susceptible to recovery or compensation, nor will personal taxes on the income of the beneficiary be considered eligible, and the tax base of the supporting documents must be allocated as an expense for invoices and other documents that include VAT, excluding said tax. c) Expenses related to hired personnel, except those indicated in section 2 A) above, which are included in the current expenses line. d) Interest debits from bank accounts. e) Interest, surcharges and administrative and/or criminal sanctions. f) Expenses of judicial proceedings. g) The acquisition of used capital goods. h) Construction, acquisition or improvement of real estate, including the purchase of land and expenses related to it, understood as permanent buildings or constructions that constitute real estate carried out through projects or reports. i) Purchase of passenger vehicles, considered as such cars intended for the transportation of people that have at least four wheels and that have, in addition to the driver's seat, a maximum of eight seats, according to the definition contained in Royal Legislative Decree 6/2015, of October 30, Law on Traffic, Circulation of Motor Vehicles and Road Safety. j) Office furniture. Article 2.- Applications, deadline, place of submission and rectification process. 1. Applications will be formulated in accordance with the model that appears as Annex I of the corresponding line for which the subsidy is requested attached to this call, duly signed and completed by the applicant, also accompanying the documentation indicated in article 4.
