Official description of the call

By agreement of the Local Government Board of May 23, 2023, the regulatory bases for the call for the aid program for the installation of charging points for electric vehicles for leisure tourism companies in Donostia/San Sebastián were approved. On June 5, 2023, the Call and Regulatory Bases for the call for the aid program for the installation of charging points for electric vehicles for leisure tourism companies in Donostia/San Sebastián were published in the Official Gazette of Gipuzkoa (BOG). It is considered necessary to modify some aspects of the bases, fundamentally related to the characteristics of the aid granted to legal entities. It has been found that these subsidies do not comply with the requirements of Regulation (EU) 651/2014 declaring certain categories of aid compatible with the internal market in application of articles 107 and 108 of the Treaty. However, it does comply with Commission Regulation (EU) 1407/2013 of December 18, 2013 on the application of articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid. Furthermore, the deadline for this call is open, so it has no impact on the application deadline. For the above reasons, article 1.4 of the Regulatory Bases of the aid program for the installation of vehicle charging points for tourist leisure companies in Donostia/San Sebastián, approved at the Local Government Board of May 23, 2023 within the framework of the Recovery, Transformation and Resilience Plan - Financed by the European Union - NextGenerationEu is drafted in accordance with the following literal wording: 4.- All recipients latter of this aid, both natural persons carrying out economic activity (Self-Employed) and legal entities, their granting will be subject to the requirements and limits established in Commission Regulation (EU) No. 1407/2013, of December 18, 2013, relating to the application of articles 107 and 108 of the Treaty on the Functioning of the EU to de minimis aid without prejudice to the rest of the provisions of both national law and the EU that could be applicable, particularly those that are approved in the field of execution and management of both the Recovery and Resilience Mechanism and the Recovery, Transformation and Resilience Plan. Thus, the total amount of de minimis aid that may be granted to each of the ultimate recipients may not exceed €200,000 during any period of three fiscal years. For these purposes, those affected by this regime must present an express responsible declaration of the aid received in relation to compliance with the corresponding quantitative limit in three fiscal years, the fiscal year in question and the two previous fiscal years, taking the moment of granting the aid for the calculation.
