Official description of the call
Law 12/2008, of December 5, 2008, aims to promote and guarantee within the Basque Country the right to social benefits and services through the regulation and organization of a universal Basque Social Services System. Article 6 establishes the purpose of the Basque Social Services System (SVSS): a) Promote personal autonomy and prevent and attend to personal and family needs derived from dependency. b) Prevent and address the needs caused by a situation of lack of protection. c) Prevent and address situations of exclusion and promote the social integration of individuals, families and groups. d) Prevent and attend to personal and family needs caused by emergency situations. Article 16 defines the economic benefits of the SVSS and article 22.3 categorizes the different economic benefits. Among them, it is worth highlighting benefits 3.5, economic benefits that can be established within the framework of the purposes of the SVSS. The aid regulated in these bases is subject to this categorization. Article 1. —Object and definition. The purpose of this rule is to regulate the granting of direct and exceptional subsidies to prevent and address situations of exclusion and promote the social integration of people and families, in accordance with the provisions of article 22.2.c) and 28.3 of Law 38/2003, of November 17, General Subsidies. These municipal aid are financial benefits of an economic nature intended for those people, residents of the municipality of Mondragón, whose income is insufficient to meet specific expenses, of an extraordinary nature, necessary to prevent, avoid or alleviate situations of social exclusion. These aids are finalist in nature, and must be used exclusively for the concept for which they have been granted. They will be used to cover needs generated in the calendar year of the concession. They are subsidiary, and where appropriate complementary, to all types of benefits and social resources provided for in current legislation. These municipal aids require the mandatory professional assessment, carried out by the social worker, based on the initial assessment of needs and taking as a reference the current legislation regarding the assessment of situations of social exclusion. Article 2. —Beneficiary persons: Requirements and obligations General Requirements. Those who meet the following general requirements may be beneficiaries of non-periodic municipal aid (ANPM): Participate in a personalized care plan, agreed upon with the reference social worker that will materialize in a social report. The processing of this benefit must be an activity, part of the social inclusion process that has been established. Be of legal age, except in the case of minors who, in turn, have other minors in their care. Not having the income and assets determined in each concept. Comply with the specific requirements required for each concept of aid Obligations. The obligations of the beneficiaries of the ANPM are: a) Apply the benefits received to the purpose for which they were granted. b) Justify the aid granted except for food expenses, where proof of expense will not be required. c) Inform your reference social worker immediately of any change that occurs in your situation that affects compliance with the requirements that could have given rise to access to benefits and specifically the following: — Changes in the cohabitation unit. — Changes related to the address of habitual residence. — Modification of the income and/or assets that have served as the basis for calculating the benefit. d) Refund the amount of benefits improperly received or in an improper amount. e) Appear before social services and collaborate with them whenever required. f) Comply with the personalized care plan agreed upon with your reference social worker. Article 3. — Types of aid, amounts and access requirements for each of them. Requirements common to the three types of aid: — Be registered in the municipality of Mondragón on the date the aid application is submitted. — Not having income
