Official description of the call
1. Purpose of the call The purpose of these rules and call is to regulate the conditions and procedure for the granting by the Andratx City Council of aid for the acquisition of the first home, built or under construction, second-hand or newly built, to promote access to housing for residents of the municipality. The present aid is in accordance with the line of subsidies of the Strategic Subsidy Plan for the years 2023-2025 in its Compromís 8 to generate a new model of local housing policies from a social logic, increasing the options for access to housing. The granting of the aid contemplated in this call will be subject to the principles of publicity, transparency, concurrence, objectivity, equality and non-discrimination, as well as effectiveness in meeting objectives and efficiency in the allocation and use of public resources. 2. Regulatory Bases Andratx Subsidies Ordinance, published in BOIB No. 47, of April 20, 2017 (http://www.caib.es/eboibfront/ca/2017/10643).3. Financial allocation3.1.- The amount of €45,000 will be allocated to the aid covered by this call, charged to item 150.78001 of the budget year 2024.3.2.- The maximum amount of subsidies awarded will be €3,000 per home acquired by the applicants. 4. Beneficiaries People who meet the following requirements can qualify for this call: 4.1.a) Be a natural person, legal resident in the municipality and with a minimum seniority on the municipal registry of two years. 4.1.b) Acquire a home through public deed for onerous title alone or jointly with other owners. The subsidized amount is per home acquired and will be prorated among the co-owners who request the aid as long as they habitually reside there as their first home. 4.1.c) That the home acquired is located in the municipal territory of Andraitx and is the habitual residence of the beneficiary or their dependents, understood as the home in which they reside for a continuous period of three years. The home must become the habitual residence of the beneficiary or his dependents within a maximum period of twelve months following the date of acquisition or completion of the works. However, it will be understood that the home had that character when, despite this period not having elapsed, circumstances arise that necessarily require the change of home, such as celebration of marriage, marital separation, job transfer, obtaining a first occupation or a more advantageous occupation or other similar ones. When the home has been inhabited effectively and permanently by the beneficiary within a period of twelve months, counted from the date of acquisition or completion of the works, the three-year period provided for in the previous paragraph will be computed from this last date. 4.1.d) First home aid cannot be granted when the owner/s who has habitual and permanent residence in the home is the owner or usufructuary of another home in Spain. For this purpose, it will be considered that you are the owner or usufructuary of a home only if the right falls on more than 50% of it. Exceptions to this requirement are those people who are owners or usufructuaries of a home and prove that they do not have the use and enjoyment of it for any of the following reasons: • Separation or divorce. • Any other cause beyond their control, duly accredited. • When the home is not accessible due to the person's disability. owner or a member of the cohabitation unit.4.1.e) That the maximum useful area of the home is 150m2, in the event that the applicant proves to be a large family, this requirement will be that the home does not exceed the maximum useful area of 180m2.4.1.f) That the acquisition price of the home, without the expenses and taxes inherent to the acquisition, is equal to or less than €300,000.
