REGULATORY BASES OF THE PROCEDURE FOR DIRECT GRANTING OF FINANCIAL AID FOR NATURAL PERSONS RESIDING IN GUADASSUAR AFFECTED BY THE FLOODS SUFFERED ON OCTOBER 29, 2024 IN THE MUNICIPALITY OF GUADASSUAR. “AMANCIO ORTEGA FOUNDATION” FIRST BASE. PURPOSE The purpose of these rules is to regulate the procedure and requirements for the direct granting of urgent aid to individuals residing in the municipality of Guadassuar and who have suffered damage to their habitual residence, furniture, belongings, appliances, vehicles necessary for work or the loss of source of income caused by the floods that occurred on October 29 as a consequence of the rain and wind storm caused by the DANA that began in the Valencian Community on October 28, 2024, in compliance with the obligation acquired by the Guadassuar City Council by accepting the conditional donation in the amount of 1,750,000 euros, made by the Amancio Ortega Foundation for this precise need. The amount of the aid will be used to alleviate material damage, losses or losses suffered as a result of the DANA. For this purpose, three lines of help are established: - LINE 1: HABITUAL HOUSING: Aid aimed at alleviating emergency situations of individuals whose habitual residence, furniture, belongings and appliances have been affected by DANA. - LINE 2: VEHICLES: Aid intended to alleviate emergency situations for natural persons arising from the loss of vehicles damaged by DANA, understood as cars and motorcycles. - LINE 3: LOST SOURCE OF INCOME: Aid intended to alleviate emergency situations of natural persons whose source of income has been seriously affected by DANA, with those natural persons holding active economic activities as of October 29, 2024, carried out in establishments located on the ground floor, being susceptible to receiving the aid. SECOND BASE. APPLICABLE REGULATIONS. Taking into account the nature of this aid and due to the type of purpose it has, the requirement of being up to date with tax or Social Security obligations is exempt. The applicable legal regime for everything not provided for in this regulation is additionally contained in: - Law 38/2003, of November 17, General Subsidies. - Royal Decree 887/2006, of July 21, which approves the Regulation of Law 38/2003.0 - Law 1/2015, of February 6, of the Generalitat of Public Finance, of the Instrumental Public Sector and of Subsidies. - Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. THIRD BASE. REASONS OF PUBLIC INTEREST WHICH CONTRIBUTE TO ITS GRANT AND IMPOSSIBILITY OF ITS PUBLIC CALL. These subsidies are granted directly, in application of the provisions of article 22.2.c) of Law 38/2003, of November 17, general on subsidies, in relation to what is established in sections 2 and 3 of article 28 of the aforementioned law, due to reasons of public, social, economic and humanitarian interest due to the damage caused by the floods as a result of the storm that began on October 28, 2024 in the Community. Valencian. The subsidies regulated in these bases have a unique character, derived from the exceptional and unique nature of the events that motivate the procedure in question. Given the specific purpose of the subsidies, a direct concession is required and a public call is not appropriate. Specifically, the reasons of public interest that justify the direct granting of subsidies lie in the emergency situation and in the extraordinary and urgent need to assist individuals residing in Guadassuar whose essential assets or way of life have been affected by the floods. Likewise, and in compliance with the applicable legal system, these bases include the conditions imposed by the donation made by the Amancio Ortega Foundation, which fully finances this measure, to which the Guadassuar City Council has agreed. FOURTH BASE. REQUIREMENTS TO BE A BENEFICIARY PERSON AND ELIGIBLE OBJECTS. 1. Individuals residing in the municipality of Guadassuar who have suffered damage may be beneficiaries of this subsidy.
