Official description of the call
In accordance with the provisions of articles 17.3.b) and 20.8.a) of Law 38/2003, dated November 17, general of subsidies, the extract of the call is published, the full text of which can be consulted in the National Subsidies Database (http://www.pap.minhap.gob.es/bdnstrans/index). First. Beneficiaries 1. Microenterprises, small and medium-sized enterprises (PEME) in the forestry sector located in Galicia may be beneficiaries in relation to investments made in rural areas, in accordance with the location criteria established in the territorial scope of the Strategic Plan of the Common Agrarian Policy of Spain 2023-2027 and described in Annex XIV, with the exception of those applicants who, in addition have or domicile in areas defined as ZDP, request non-fixed investments to carry out work within the territorial scope of the Strategic Plan of the common agrarian policy of Spain 2023-2027. For these purposes, the definition of peme included in Annex I of Regulation (EU) 2022/2472 of the Commission, dated December 14, will be taken, which is why certain categories of aid are declared in the agricultural and forestry sectors and in rural areas compatible with the internal market, in application of two articles 107 and 108 of the Treaty on the functioning of the European Union (OJEU L 327/1, do 12/21/2022). 2. Applicants for assistance to become beneficiaries must meet the following requirements: a) Prove their economic viability through some of the following circumstances: 1. Availability of bank credit for the investment of a minimum of 70% of the amount or bank communication of being willing to grant financing. 2nd Bank certification of liquid cash availability for the amount of the investment. 3º Sales for an amount greater than three times the investment (the IVE declaration of the last financial year issued on the date of publication of the call - model 390 or model 303 of the last month of the year, second as applicable). b) They must have valid civil liability insurance for the activity intended for the aid and, not assumed to be exixible, a contract for the prevention of labor risks in force as of the date of publication of the call. c) They must be registered in the Registry of Forestry Sector Companies (Resfor) and with updated data, in accordance with article 102 of Law 7/2012, of June 28, of the mountains of Galicia, in accordance with Decree 50/2014, of April 10, which regulates the use of wood and wood. cortiza, pastures and mycolosics in mountains or forested lands of private management in the Autonomous Community of Galicia, and the content, organization and functioning of the Registry of Companies in the Forestry Sector. d) Sawing lines may not exceed a maximum transformation capacity of 20,000 m3 of wood into input rounds for sawing each year, in accordance with the definition of operations prior to industrial transformation of wood in Commission Regulation (EU) 2022/2472, dated December 14, which declares certain categories of aid in the agricultural and forestry sectors and in rural areas compatible with internal market, in application of two articles 107 and 108 of the Treaty on the functioning of the European Union. 3. The following will not be able to qualify as beneficiaries: a) Those applicants who meet any of the circumstances provided for in Article 10 of Law 9/2007, dated 13 June, on Galician subsidies. b) Those companies that fall within the category of companies in crisis, in accordance with the definition of Regulation (EU) 2022/2472 of the Commission, of December 14, 2022, for which certain categories of aid are declared in the agricultural and forestry sectors and in rural areas compatible with the internal market, in application of two articles 107 and 108 of the Treaty on the functioning of the European Union. To verify or fulfill this requirement, the applicant companies must declare in the application that they are not in a crisis situation in accordance with community regulations. c) Those companies that are subject to a pending recovery order following a Commission decision that has declared aid illegal and incompatible with the common market. d) Companies that fail to comply with the payment deadlines provided for in Law 3/2004, dated December 29, by which loita measures are established against late payments in commercial operations, for subsidies of amounts greater than 30,000 euros and when applicants apply for certain subjects included in the scope of application of the aforementioned
