Official description of the call
First. Beneficiaries The following entities may be beneficiaries: Associations, federations, confederations and unions of associations established under Organic Law 1/2002, of March 22, regulating the Right of Association. Unions, federations and trade union confederations established under Organic Law 11/1985, of August 2, on Freedom of Association, as of the end date of the application submission period. As a requirement, the statutes or operating rules of the entities must indicate that their purposes are totally or partially oriented to the promotion of all or any of the following purposes: Defense of the conditions of the cultural professional sector. Participation in the definition and design of cultural policies. Promotion of equality and diversity in the cultural field. Implementation of good cultural practices. Defense of cultural rights and strengthening of community networks. Excluded are natural persons, Public Administrations, their autonomous bodies, public companies and other public entities, for-profit entities, foundations, as well as economic interest groups (A.I.E.) and temporary joint ventures (U.T.E.). Entities that, meeting the requirements established in this article, are recipients of any subsidy nominally provided for in the General Budgets of the State of the current year, of the Autonomous Communities or of the Local Entities or direct concessions approved by the Council of Ministers during the current year for the same purpose will not be able to obtain the status of beneficiaries. In addition to compliance with the provisions of section 1 of this article, the applicant entities must meet, at the end of the deadline for submitting applications, the following requirements: Be legally constituted and registered in the corresponding State Registry: Have their own legal personality, capacity to act and not fall into the cases contemplated in sections 2, 3 of article 13 of the LGS and in article 21 of the LGS Regulations. The justification by the persons or entities of not being subject to the prohibitions to obtain the status of beneficiary will be carried out in the manner established in article 13.7 of the LGS. Not be involved in subsidy reimbursement procedures. Have a scope of state action expressly stated in its constitutive title. Non-profit. Have your domicile in Spain. That the main part of its actions be carried out in national territory. Have carried out an uninterrupted activity, at least, during the two calendar years prior to the call, that is, 2023 and 2024. Be up to date with compliance with tax and Social Security obligations. Not having been sanctioned by a final resolution with the loss of the possibility of obtaining subsidies in accordance with the LGS. Likewise, beneficiary entities must prove, by signing a responsible declaration, compliance with the following requirements: In accordance with the provisions of section 5 of article 4 of Organic Law 1/2002, of March 22, regulating the Right of Association, in their admission process, in their operation they will not harm groups that suffer social discrimination due to birth, race, sex, religion, opinion or any other personal or social condition or circumstance. They may not have been definitively sanctioned through administrative, labor or criminal proceedings for violation of the right to equality and non-discrimination based on sex, or for wage discrimination, or for sexual or moral harassment, or for any other unequal treatment based on sex. They must comply with the obligations established in the legislation on gender equality. Pursuant to the provisions of article 82 of Law 4/2023, of February 28, for the real and effective equality of trans people and for the guarantee of the rights of LGTBI people, and which would cover the LGTBIQ+ group, they may not commit, incite or promote discriminatory acts or violence against LGTBI people. Failure to comply with any of these requirements will constitute grounds for exclusion from being a beneficiary of the aid.
