Agreement of July 6, 2023 of the Plenary Session of the Alicante Provincial Council approving an extraordinary call for subsidies in favor of irrigation entities for hydraulic infrastructures that increase the efficiency of water use in irrigation

Official description of the call

First. Beneficiaries: Communities of irrigators and other irrigation entities based in the province of Alicante, legally constituted and attached to the corresponding Basin Organization, in accordance with articles 81 and 82 of Royal Legislative Decree 1/2001, of July 20, which approves the Revised Text of the Water Law, which have established as their object the use of water for irrigation, and must fulfill their purpose in the territory of Alicante. the Province of Alicante. Second. Purpose: Realization and improvement of hydraulic infrastructure and installations and other investments that increase the efficiency of water use in irrigation, to be contracted and executed by the Hydric Cycle Area of ​​the Excma. Provincial Council of Alicante, in the exercise of the powers conferred on it by articles 31 and 36 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, in relation to article 25.2.c). The contracting of the works will comply with the provisions of Law 9/2017, of November 8, on Public Sector Contracts. Consequently, the activity subject to the subsidy refers to the first establishment, renovation or major repair of hydraulic infrastructures and installations, and other investments to optimize efficiency, management and control in the use of water for irrigation. Simple repair, conservation, maintenance and restoration works defined in article 232.1 sections b) and c) of Law 9/2017, of November 8, on Public Sector Contracts, may not be subject to subsidy under this call. Excluded from this call are works that involve the raising or covering of infrastructures that fulfill the function of drainage and that prevent the drainage of agricultural areas at risk of flooding, and do not comply with the provisions of articles 21.6 and 25.2 of the Territorial Action Plan on Flood Risk Prevention in the Valencian Community (PATRICOVA), approved by Decree 201/2015, of 29 October, from the Consell. No more than one request from each Entity may be attended to or, therefore, subsidized. In addition to the costs of executing hydraulic works and installations, the following will be eligible for subsidy under this call: a) In those cases in which the project presented by the irrigation entity does not comply with the requirements of the Provincial Council regarding the Health and Safety Study, the latter will assume the cost of said study. The supervision of the project presented by the Irrigation Entity will correspond to the Water Cycle technicians. b) The Excma. Provincial Council of Alicante will subsidize 100% of the costs of technical assistance inherent to the execution of hydraulic infrastructures, such as health and safety coordination fees, the cost of construction control tests that should not be assumed by the contractor (that is, those that exceed 1% PEM) and those of inspection, surveillance, measurement, technical advice and control. The construction management will in all cases correspond to the technicians of the Water Cycle Area. Third. Regulatory bases: General Subsidies Ordinance approved by the Plenary of the Excma. Provincial Council of Alicante, in session of April 14, 2005, published in the Electronic Headquarters of the Excma. Provincial Council of Alicante (http://sede.diputacionalicante.es/inicio/ordenanzas-y-tasas/) and Specific Rules included in the call. Room. Amount: The maximum total amount allocated to the financing of the call is established at 3,500,000.00 euros, of which 150,000.00 euros are attributed to application 29.4521.6501700 “INVESTMENTS IN HYDRAULIC INFRASTRUCTURES TO INCREASE THE EFFICIENCY OF WATER USE IRRIGATION, 2023-2025, TO BE EXECUTED FOR IRRIGATION COMMUNITIES AND OTHER IRRIGATION ENTITIES” of the 2023 Budget, and the remaining 3,350,000.00 euros will be allocated to the Budgets for the years 2024 and 2025, in the amounts of 1,600,000.00 euros and 1,750,000.00 euros. This is without prejudice to any variations that may occur as a result of subsequent budget modifications. Thus, in accordance with the provisions of article 58 of Royal Decree 887/2006, of July 21, which approves the Regulation of Law 38/2003, of November 17, General of Subsidies, the maximum additional amount of the call is set at 1,500,000.00 euros, the effectiveness of this additional amount being conditioned.
