Aid for the transport of passengers by road with economically deficient exploitation from January to July 2022

Official description of the call

First.- Beneficiaries. Legal entities that are providers of the public service of regular road passenger transport and whose operation is economically deficient and in which the requirements established in this order meet may be beneficiaries of the subsidy. Legal entities that are subject to any of the prohibition causes provided for in article 13 of Law 38/2003, of November 17, General Subsidies, will not be able to obtain the status of beneficiaries. Specifically, those who are not up to date with their tax obligations, both with the State Treasury and with the Administration of the Autonomous Community of Aragon, and with Social Security, will not be able to obtain the status of beneficiary. Failure to be up to date with payment of obligations for reimbursement of subsidies will prevent obtaining the status of beneficiary, in accordance with the provisions of articles 21 and 25 Regulations of the General Law of Subsidies, approved by Royal Decree 887/2006, of July 21. Second.- Object. The aid contemplated in this order is intended to subsidize the deficit generated in the provision of public services for regular road passenger transport, for general and permanent use owned by the Government of Aragon, when the individualized accounting of each of them is analyzed, their operating account in the period from January to July 2022 presents a negative balance, as a consequence of compliance with the public service obligations imposed in the public service management contract. The simple fact of the existence of a deficit in the operating accounts of a public service management contract will not determine the right of the provider to grant the aid contemplated in this order, since the principle of exploitation at the risk and fortune of the concessionaire governs, nor consequently the right to be subsidized for the entire deficit originated during that year. Third.- Regulatory bases. The regulatory bases for these subsidies are included in Order VMV/705/2016, of June 24, of the Minister of Territorial Structure, Mobility and Housing, ("Official Gazette of Aragon", number 136, of July 15, 2016), which establishes the regulatory bases for the granting of subsidies for the provision of public services for regular passenger transport by road with economically deficient exploitation modified by the Order. VMV/308/2020, of April 6, 2020, and Order VMV/839/2021, of July 5, 2021. Fourth.- Budget Credit. The aid will be granted in the amount of two million euros (€2,000,000), charged to the budget application G/13060/5132/470004/91002 of the Budgets of the Autonomous Community of Aragon for 2024, approved by Law 17/2023, of December 22, on Budgets of the Autonomous Community. This amount may be increased without the need for a new call in the cases provided for in article 42.2 of Legislative Decree 2/2023, of May 3, of the Government of Aragon, which approves the consolidated text of the Aragon Subsidies Law, conditional on the prior declaration of availability of the credit. The granting of the aid referred to in this call is subject, in any case, to budgetary availability. Fifth.- Submission of applications. The application will be compulsorily completed and signed by electronic means, through the electronic headquarters of the Government of Aragon, including in the search engine (url: https://www.aragon.es/tramites) procedure 5037 and/or the name “Subsidies for the provision of public services for regular road passenger transport with economically deficient exploitation” from the “Start process” section. This request will automatically be directed to the General Directorate of Transport. Applications completed electronically that do not complete the established submission process will not be taken into account. The submission period will be twenty business days counted from the day following the publication of the call in the Official Gazette of Aragon. The application will be considered submitted for the purposes of its processing at the time the proof of registration is obtained, which must be kept to prove, if necessary, the presentation.
