Official description of the call
1. Regulatory Bases The regulatory bases for the granting of this subsidy are contained in the Regulatory Ordinance of Birth Aid / Adoption of the Oliva de la Frontera City Council approved by the Plenary Session of the Corporation in a session dated July 22, 2022 and published in the Official Gazette of the Province of Badajoz on September 19, 2022, as well as the modification of the ordinance published in the Official Gazette of the Province No. 66 of April 8, 2024. 2. Budget Credits The budget application of expenses to which the subsidy is attributed is 232,480 of the 2024 Municipal Budget. 3. Object, Conditions and Purpose of the Subsidy This Ordinance is based on the powers granted by article 2 and 25.1 of Law 7/1985, of April 2, 2024. April, Regulator of the Bases of Local Regime, grants to this City Council. All this in order to satisfy the needs and aspirations of the residents of this municipality. The Oliva de la Frontera City Council has among its priorities support for families and births, the object of this Ordinance being the regulation of the legal regime for granting aid for the birth or adoption of children under three years of age. The limit of aid, for each financial year, will be that of the existing budget allocation. The birth aid established by the Oliva de la Frontera City Council is compatible with any other aid established by other public or private entities with the same purpose. The present aid is exempt from the Personal Income Tax, by application of article 7.z) of Law 35/2006, of November 28, on the Personal Income Tax and partial modification of the laws on Corporate Taxes, on the Income of Non-Residents and on Wealth (in the wording given by number one of the first final provision of Law 35/2007, of November 15, which establishes the deduction for birth or adoption in the Personal Income Tax and the economic benefit of a single payment from Social Security for birth or adoption). 4. Requirements of Applicants 1.- Be the parent or adopter of a child born in the period established in the call for aid, who has been registered in Oliva de la Frontera since birth or adoption. 2.- Be Spanish or a foreigner with legal residence in Spain. Foreigners residing in Oliva de la Frontera may benefit from this benefit as long as they meet the conditions of Organic Law 4/2000, of January 11, on the rights and freedoms of foreigners in Spain and their social integration. 3.- The applicant parent must be registered at the address in Oliva de la Frontera, for three consecutive months immediately preceding the event that gives the right to obtain the requested aid. 4.- Not be subject to a prohibition on obtaining public aid. 5.- Not having been totally or partially deprived of the parental rights of their children or whose guardianship has been assumed by public institutions. 6.- Be up to date with tax obligations with the Tax Agency and Social Security. 7.- Be up to date with tax obligations with the treasury of the municipality of Oliva de la Frontera. 5. Competent Body for Instruction and Resolution The request will be resolved by the Mayor's Office and the interested parties will be notified following the provisions of articles 40 et seq. of Law 39/2015, on the Common Administrative Procedure of Public Administrations. The period to resolve and notify the resolution will be six months from the day following the date of submission of the application. Once this period has elapsed without an express resolution having been received, the applications submitted will be deemed rejected, for the purposes of filing the corresponding administrative or other appeals. The competent body to resolve will be the Mayor's Office, in accordance with art. 9 of the General Regulatory Ordinance. 6. Deadline for Submission of Applications and Documentation Submission of applications: Applications, in accordance with the standard model in Annex 1, addressed to the Mayor-President of the Corporation, will be submitted to the General Registry of the City Council or by the procedures provided for in article 16 of Law 39/2015, of October 1, Regu
