Official description of the call

In accordance with the provisions of articles 17.3.b. and 20.8.a of Law 38/2003, of November 17, General Subsidies, the extract of the call and specific bases are published, the full text of which can be consulted in the National Subsidies Database (http://www.pap.minhap.gob.es/bdnstrans/index): First.- Beneficiaries: a) The natural or legal persons, public or private, owners or usufructuaries of single-family homes isolated or grouped in a row and those of residential buildings of collective housing to which this call refers, as well as their homes. b) Public Administrations and organizations and other public law entities and public companies and commercial companies wholly or majority owned by the Public Administrations that own the properties. c) The communities of owners or groups of communities of owners constituted in accordance with the provisions of article 5 of Law 49/1960, of July 21, on Horizontal Property. d) Groups of building owners that meet the requirements established by article 396 of the Civil Code and have not granted the title constituting horizontal property. e) Cooperative societies made up of groups of owners of homes or buildings that meet the requirements established in article 396 of the Civil Code, as well as by owners who form communities of owners or groups of communities of owners constituted in accordance with the provisions of article 5 of Law 49/1960, of July 21, on Horizontal Property and by cooperatives under a regime of transfer of use of their homes. f) The tenant or concessionaire companies of the buildings, as well as the cooperatives that accredit said condition, through a current contract, which grants them the express power to undertake the rehabilitation works that are the object of the program. g) The tenants of the homes when it has been agreed with the owners of the same that they pay for the corresponding rehabilitation actions at their expense, in exchange for the payment of the rent, and the appropriate agreement of the community of owners or the sole owner necessary to benefit from the aid has been adopted. Second.- Purpose: Regulate the procedure for requesting, processing, granting and paying aid intended for the financing of the joint execution of rehabilitation works in buildings with predominantly residential use and homes, including single-family homes and urbanization or redevelopment of public spaces within the Programmed Rehabilitation Residential Environment (ERRP) of the municipality of Calasparra. Third.- Regulatory bases: Agreement signed on March 16, 2023, between the Ministry of Transport, Mobility and Urban Agenda, the Autonomous Community of the Region of Murcia and the Calasparra City Council, the corresponding ACB related to the ERRP "Calasparra. Phase I" which includes the direct granting of aid to the Calasparra City Council. Considering that in accordance with article 23.2 of Law 7/2005, of November 18, on Subsidies of the Autonomous Community of the Region of Murcia, by Decree of the Government Council No. 99/2023 of March 30 (BORM No. 78, of April 4, 2023), the special rules regulating the direct granting to the Calasparra City Council of aid in the amount of €142,110.79 under Program 1 “Aid for rehabilitation actions at the neighborhood level” of Royal Decree 853/2021, of October 5. Considering that in accordance with the provisions of RD 853/2021 of October 5, the City Council will process and resolve the procedure for granting and paying the aid that corresponds to the ultimate recipients through the corresponding public call. Article 17.2 of Law 38/2003, General Subsidies, provides that the regulatory bases for the subsidies of Local Corporations must be approved within the framework of the budget execution bases, through a general subsidy ordinance or through a specific ordinance for the different types of subsidies.
