AID FOR THE REPAIR OF TOMBSTONES DAMAGED BY DANA IN THE TERRITORY OF THE MUNICIPALITY OF HUELVA, BETWEEN OCTOBER 29 AND NOVEMBER 3, 2024

Official description of the call
Between October 29 and November 3, 2024, the municipality of Huelva was affected by an Isolated Depression at High Levels (hereinafter, DANA) involving a very high intensity rain storm that has affected thousands of citizens. The municipality of Huelva has been one of those directly affected by the damage suffered as a result of the rain storm that took place between October 29 and November 3, 2024. in regards to goods and infrastructure and services. But, above all, the floods have damaged or destroyed homes, belongings, furniture, vehicles of the people most directly affected, without forgetting the irreparable loss of human life. The Council of Ministers, at its meeting on November 5, 2024, adopted an agreement declaring the territory affected as a result of the Isolated Depression at High Levels (DANA) an "Area seriously affected by a civil protection emergency", with Huelva being among the affected municipalities. Considering the applicable regulations, and specifically Law 38/2003, of November 17, General Subsidies and Royal Decree 887/2006, of July 21, which approves the Regulation of Law 38/2003, of November 17, General Subsidies and taking into account that the damage caused to the tombstones of the municipal cemetery has not been covered by aid from other administrations nor by insurance companies. For all of the above, taking into account the distribution of municipal powers and the concurrent circumstances, the granting of this aid will be governed by the following bases: First base. Object. The purpose of these bases is to regulate the procedure and requirements for the granting through a procedure of direct granting of urgent aid to natural persons residing in the municipality of Huelva who hold the right to use niches, tombs or graves whose tombstones have been affected by the incidents produced by the impact of the isolated depression at high levels (DANA) in the territory of the municipality of Huelva, between October 29 and November 3, 2024. Nature catastrophic nature of the events and the impossibility, due to their uniqueness and urgency, of applying a competitive competition regime, determine the application of the direct concession regime for reasons of public, social and humanitarian interest, in accordance with Law 38/2003, of November 17, General Subsidies, article 22.2.c). The aid will be intended exclusively for the repair, replacement or replacement of the tombstone damaged or destroyed due to the aforementioned catastrophe, not adequately covered by insurance or other subsidies or compensation. Second base. Applicable regulations. For matters not provided for in these bases, the provisions of the Municipal Budget execution bases, Law 38/2003, of November 17, General Subsidies (hereinafter LGS), Royal Decree 887/2006, of July 21, which approves the Regulations for the development of the LGS (hereinafter RLGS), Royal Decree 307/2005, are applicable. of March 18, on subsidies for catastrophes and, additionally, in Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations and any other regulatory provision that, due to its nature, may be applied. Third base. Concession procedure. The procedure will be by direct concession for reasons of social and humanitarian interest, in accordance with article 22.2.c) LGS. It is processed through the emergency procedure, in accordance with article 33 of Law 39/2015, taking into account the nature of the aid and the immediate need to address the damages suffered. Applications will be attended to within the available credit and, in case of insufficiency, a proportional proration of the maximum amount will be applied to applicants who meet the requirements. Preference is also declared for the offices related to their processing, for the purposes provided for in article 71.2 of the aforementioned law. Fourth base. Beneficiaries and access requirements. Natural persons who meet all of the following requirements may be beneficiaries of this subsidy:• Be of legal age on the date of the DANA.• Be a resident in the municipality of Huelva, being accredited before November 3, 2024, by means of a registration certificate or any other means valid in Law.• Hold the title.
