Official description of the call
Article 1.-Object and definition. The purpose of this rule is the special regulation of the granting of direct emergency subsidies to prevent and address situations of exclusion, and promote the social integration of people and families, in accordance with the provisions of article 22.2 c) and 28.3 and related, of Law 38/2003, of November 17, General Subsidies (hereinafter, LGS). These emergency aid are non-periodic benefits of an economic nature intended for those people registered in the municipality of Portugalete whose resources are insufficient to meet specific expenses, of an extraordinary nature, necessary to prevent, avoid or alleviate situations of social exclusion. They are finalist in nature, and must be used only for the purpose for which they were granted. Likewise, they are subsidiary in nature, and where appropriate complementary, to all types of social resources and benefits of economic content provided for in current supra-municipal legislation that may correspond to the beneficiary or to any of the members of their cohabitation unit. It is of public, social, economic and humanitarian interest to provide an adequate response to the needs of people who do not have the financial means to meet the specific expenses included in the articles of these regulatory bases. Failure to address these needs puts individuals and families at serious risk. Taking into account that these circumstances may occur again throughout the year, the regulation must maintain the principles of equality, objectivity, transparency and non-discrimination. The maximum annual amounts of direct social emergency aid, per cohabitation unit (hereinafter UC), destined for each of the expenses/concepts are those specified in articles 4, 5 and 6 of the regulatory bases. The possibility of being able to make more than one request is established as long as they do not exceed the maximum annual amounts contemplated in each type of expense of the articles mentioned above. The possibility of making advance payments is established based on the social and urgent nature of this aid. Article 2. Regulatory bases. The Regulatory Bases for the granting of direct emergency financial aid to prevent and address situations of exclusion of the Department of Social Services and Equality of the Portugalete City Council are approved by the Plenary Session of the Portugalete City Council, in an ordinary session held on March 26, 2026 (BOB no. 66, of April 10, 2026). Article 3.- Requirements of the beneficiaries. In accordance with the provisions of article 13 of Law 38/2003, of November 17, General Subsidies, and taking into account the nature of these social emergency aid, people who meet the following requirements may obtain the status of beneficiaries, without prejudice to the exception provided for concept 5.C), of the regulatory bases: Being of legal age; except in the cases of minors who, in turn, have other minors in their care. Not having 100% owned real estate (with the exception of the habitual residence, garage and storage room in the municipality of residence). For the purposes of denying the benefit, properties other than the habitual residence and that are not for residential use, which have a value of less than 10,000 euros, will not be considered property for the purposes of denying the benefit. Except for the following exception: In the case of people who have been forced to leave their habitual residence due to lack of accessibility in the case of a situation of disability/dependency, due to separation or divorce, eviction, being a victim of sexist or domestic violence who have filed a complaint and it has been admitted for processing, have a ruling, a prosecutor's report, a protection order or similar credential in force at the time of the application, or have obtained accreditation of the situation of gender violence issued by the Directorate of Social Services of the Basque Government or of a similar nature, or others such as situations arising due to loss of housing in a catastrophe and/or emergency situation.
