Call for Subsidies for Grouped Support Secretary-Intervention 2023 AGREEMENT OF THE GOVERNMENT BOARD OF NOVEMBER 28, 2023 Considering the Call for Subsidies for Grouped Support for the position of Secretary - Intervention in town councils in the province of Ciudad Real, prepared by the Municipal Assistance Area of this Provincial Corporation. Considering that the groups created under this line of subsidy are being accredited as an effective way to guarantee the functions reserved in municipalities with lower economic capacity. Considering that the concession procedure and the content of the aforementioned call comply with the Regulations regulating the Municipal Economic Assistance and Cooperation Plan, approved by the Plenary Session of this Provincial Council, in a session dated April 29, 2022, (B.O.P. no. 121, of June 24 of the following year) and in particular with the provisions of its articles 6.1) and 7. Considering that the competence for its approval corresponds to the Governing Board, by virtue of the delegation agreement adopted by the President through resolution number 2023/8796, of July 11. It is proposed to the Government Board to adopt the following agreement: Considering the Strategic Subsidy Plan of this Provincial Council approved by Presidential Decree of May 2, 2023, it is proposed to the Government Board of this Provincial Council to adopt the following agreement: First.- Approve the Call for Subsidies for the Grouped Support of the position of Secretary-Intervention 2023 in town councils in the province of Ciudad Real, prepared by the Technical Support Unit to the City Councils of this Provincial Corporation. Second.- Process the file as determined in the text of the call for aid itself, which is as follows: CALL FOR SUBSIDIES FOR THE GROUPED SUPPORT OF THE POSITION OF SECRETARY-INTERVENTION IN CITY COUNCIL OF THE PROVINCE OF CIUDAD REAL. Explanation of reasons: Currently there are many municipalities that do not comply with the conditions to be exempt from maintaining the Intervention Secretariat job, in accordance with the provisions of article 10 of Royal Decree 128/2018, of March 16, which regulates the legal regime of Local Administration officials with national authorization (population less than 500 inhabitants and budget less than 200,000 euros). However, on the one hand, the lack of resources to meet the expense of the existence of a national authority is notable, and on the other hand, due to its limited nature, we find an insufficient number of tasks that justify the presence of one of these officials in a single municipality, with the high cost that this entails. Therefore, uniting the two previous premises, the voluntary grouping of smaller-volume Local Entities is proposed as another alternative to cost containment in chapter 1, but without affecting either the rights of these officials, or the guarantee of the provision of the functions reserved for them. Normatively, article 9 of the aforementioned Royal Decree establishes that local entities whose volume of services or resources is insufficient may jointly and through grouping hold the position of Secretariat, which will be responsible for administrative responsibility for its functions in all the grouped entities. For this reason, it is considered convenient to facilitate the municipalities to group together to maintain the Secretariat-Intervention job in common, guaranteeing, as we have already advanced, on the one hand the provision of the functions entrusted to them, vital for the proper functioning of our Local Entities, and on the other the adequate efficiency, understood as the correct ratio between the functions provided and their cost, but without forgetting that the official must be sufficiently compensated. Furthermore, article 36.1.b of Law 7/85, in the wording given by Law 27/2013, establishes that the Provincial Councils will guarantee in municipalities with less than 1,000 inhabitants the provision of secretarial and intervention services, being undoubtedly the partial financing of these officials, in municipalities with a smaller population, an effective way to guarantee the provision of reserved functions.
