RIBERA ALTA CITY COUNCIL Regulatory bases for the call for subsidies to repair damage suffered by hail in homes and other buildings subject to agricultural/livestock exploitation during the year 2023 BACKGROUND The Ribera Alta City Council approved the Strategic Subsidy Plan for the period 2022-2024, in an ordinary plenary session held on 04/07/2022 and its final approval was published in the BOTHA number 104, of September 12, 2022. The aid that is called is included in the Strategic Subsidy Plan, within subject number 1.- Social action: promotion of equality between men and women, job insertion, integration, senior citizens (training, leisure and free time, trips, excursions, classrooms...etc.), transportation of people, education aimed at children and youth, health prevention, continued training, financing solidarity projects and support for countries disadvantaged, collaboration with administrative boards, damage due to natural disasters, fires and force majeure, Euskal Fondoa, AMPA, etc. This call is governed by the municipal ordinance regulating subsidies of the Ribera Alta City Council, whose final approval was published in BOTHA number 109, of September 23, 2022. In the 2023 financial year, the Ribera Alta city council called for aid to repair damage suffered by hail in homes and other buildings subject to agricultural/livestock exploitation during the year 2023. However, the call published in the BOTHA with number 131, dated November 8, 2023, was void. The purpose of this call is to be able to offer aid by extending the application submission period. Article 1. Purpose of the call The purpose of these rules is to regulate the procedure for granting the subsidy aimed at repairing homes and other buildings that have suffered hail damage in the municipality of Ribera Alta during the year 2023 when the repair requires a municipal construction license. This organization wishes to help in the repair of damage caused by hail due to its economic impact. Article 2. Legal regime The subsidies granted in this call will be governed, in addition to these bases, by the provisions of the following regulations: • Law 2/2016, of April 7, on Local Institutions of the Basque Country • Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations • Law 38/2003, of November 17, General of Subsidies • Royal Decree 887/2006, of July 21, which approves the Regulation of the General Law of Subsidies • Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights • General municipal ordinance of subsidies of the Ribera Alta City Council • The bases of budget execution The subsidies that are granted will be on a competitive basis, through an open call, until the budget credit is exhausted. Subsidies will be awarded in accordance with the principles of: Publicity, transparency, concurrence, objectivity, equality and non-discrimination Efficiency in meeting the established objectives Efficiency in the allocation and use of public resources The mere presentation of a subsidy application implies knowledge and acceptance of these bases, the general subsidy ordinance of the Ribera Alta City Council, and Law 38/2003, of November 17, General Subsidies, as well as any applicable regulations. to this type of subsidies. Article 3. Eligible concepts 3 percent of the cost of repair (VAT excluded) in housing or other buildings due to hail damage will be subsidized when the repair requires a building permit and has been paid for. Damaged properties must be insured against atmospheric damage. The maximum amount of the subsidy per beneficiary person or entity may not exceed 3,000.00 euros. Article 4. Budgetary Allocation The aid granted under this call will be financed from the following budget allocation: 10,000.00 euros, charged to budget application 1522.480000 – 'Subsidy for conservation and rehabilitation of buildings due to hail damage' from the general budget of the Ribera Alta City Council for the year 2024.
