Agreement of the Executive Council, of September 23, 2024, regarding the approval of the bases of the aid of the Island Council of Menorca for the Health Defense Groups of Menorca (ADS) and the call corresponding to the year 2024

Official description of the call

First. Beneficiaries 1. The ADS of Menorca made up of producers who meet the requirements of point 2 of this base, in addition to the following, may be considered direct beneficiaries and request the subsidy: a) Before the application submission period ends, the ADS is legally constituted and recognized in accordance with the provisions of Royal Decree 842/2011, of June 17 (BOE no. 168, of July 14, 2011), and Decree 42/2021 of October 11, which regulates the operation of livestock health defense groups in the Balearic Islands (BOE no. 140 of October 12, 2021). b) That it is registered in the National Registry of livestock health defense groups. c) That it has a common health program approved by the General Directorate of Agriculture, Livestock and Rural Development, of the Government of the Balearic Islands, with the minimum content established by Decree 42/2021, of October 11, according to the animal species. The mentioned program must necessarily include the health measures that appear in Annex III of Decree 42/2021. d) That has the status of PIME, in accordance with Annex I of Regulation (EU) no. Commission 2022/2472 of 14 December 2022, declaring certain categories of aid in the agricultural and forestry sectors and in rural areas compatible with the internal market in application of articles 107 and 108 of the Treaty on the Functioning of the European Union. e) That it is not subject to a pending recovery order after a previous decision of the Commission that has declared aid illegal and incompatible with the internal market. f) That it is not a company in crisis as defined in article 2.59 of Regulation (EU) no. 2022/2472 of the Commission, of December 14, 2022, and in the Community guidelines for state aid for rescuing and restructuring non-financial companies in crisis (Communication 2014/C249/01 of the Commission, of July 31, 2014). 2. Small and medium-sized agricultural holdings dedicated to primary agricultural production and integrated into one of the livestock health defense groups (ADS) of Menorca that meet the following requirements may be final beneficiaries of the aid provided for in the bases: a) Natural or legal persons who, at the time that the instructing body issues the proposed final resolution of the call, are up to date with compliance with their tax and Social Security obligations before the General Administration of the State. and tax obligations with the Island Council of Menorca. (The fact of being up to date with tax obligations will be verified ex officio by the corresponding Department or service). b) That they are owners of active livestock farms and that the farms have the status of PIME, in accordance with Annex I of Regulation (EU) No. Commission 2022/2472 of 14 December 2022, declaring certain categories of aid in the agricultural and forestry sectors and in rural areas compatible with the internal market in application of articles 107 and 108 of the Treaty on the Functioning of the European Union. c) That the farm is registered in the General Registry of Livestock Farms (REGA). d) That the exploitation is not subject to a pending recovery order after a previous decision of the Commission that has declared aid illegal and incompatible with the internal market. e) That it is not a company in crisis as defined in article 2.59 of Regulation (EU) no. 2022/2472 of the Commission, of December 14, 2022, and in the Community guidelines for state aid for rescuing and restructuring non-financial companies in crisis (Communication 2014/C249/01 of the Commission, of July 31, 2014). Second. Purpose The purpose of the call for aid to the ADS is to offset the cost of actions to prevent, control, combat and eradicate animal diseases included in the health and zootechnical programs of the ADS of sheep and cattle of Menorca approved by the DG of Agriculture, Livestock and Rural Development of the Government of the Balearic Islands.
