Official description of the call
First base. Purpose The purpose of these bases is to regulate the procedure and requirements for the direct granting of urgent aid to individuals residing in the municipality of Beniparrell and who have suffered damage to their habitual residence, furniture, belongings, appliances, vehicles necessary for work or the loss of source of income caused by the floods that occurred on October 29 as a consequence of the rain and wind storm caused by the DANA that began in the Valencian Community on October 28, 2024, in compliance with the obligation acquired by the Beniparrell City Council by accepting the conditional donation in the amount of 1,200,000 euros, made by the Amancio Ortega Foundation for this precise need. The amount of the aid will be used to alleviate material damage, losses or losses suffered as a result of the DANA. Second base. Applicable regulations. For what is not provided for in these bases, the bases of execution of the Municipal Budget, Law 38/2003, of November 17, General Subsidies (hereinafter LGS), Royal Decree 887/2006, of July 21, which approves the Regulations for the development of the LGS (hereinafter RLGS) are applicable, except insofar as it affects the principles of publicity and competition and, supplementarily, in Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations and any other regulatory provision that, due to its nature, may apply. Third base. Reasons of public interest that contribute to its concession and impossibility of its public call. 1. These subsidies are granted directly, in application of the provisions of article 22.2.c) of Law 38/2003, of November 17, General Subsidies, in relation to what is established in sections 2 and 3 of article 28 of the aforementioned law, due to reasons of public, social, economic and humanitarian interest due to the damage caused by the floods as a result of the storm that began on October 29, 2024. in the Valencian Community. The subsidies regulated in these bases have a unique character, derived from the exceptional and unique nature of the events that motivate the procedure in question. Given the specific purpose of the subsidies, a direct concession is required and a public call is not appropriate. 2. Specifically, the reasons of public interest that justify the direct granting of subsidies lie in the emergency situation and in the extraordinary and urgent need to assist individuals residing in Beniparrell whose essential assets or way of life have been affected by the floods. 3. Likewise, and in compliance with the applicable legal system, these bases include the conditions imposed by the donation made by the Amancio Ortega Foundation, which fully finances this measure, to which the Beniparrell City Council has agreed and which have already been deposited into the accounts of this entity. 4. The urgent processing of the procedures related to this aid is declared, for the purposes of the provisions of article 33 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. Likewise, the preference of the offices related to its processing is declared, for the purposes provided for in article 71.2 of the aforementioned law. Fourth base. Requirements to be a beneficiary and eligible objects. 1. Natural persons residing in the municipality of Beniparrell who have suffered damage to their habitual residence, furniture, belongings, appliances or vehicles, except motorcycles, totally or partially damaged, may be beneficiaries of this subsidy, as a result of the damage caused by the floods of October 29, 2024. 2. Resident status is presumed “iuris tantum” (by right) from registration in the municipality of Beniparrell before the 29th. October 2024. However, for the sole purposes of acquiring the status of beneficiary in this call, evidence to the contrary will be admitted, by any legally valid means, that sufficiently accredits the status of resident in Beniparrell, before October 29, 2024. 3. The condition of habitual residence (or domicile) of the property is also presumed “iuris
