Official description of the call
First. - Object. 1. The purpose of this order is to establish the regulatory bases for the granting of agricultural aid provided for in articles 6 and 7 of Decree-Law 3/2025, of June 20, of the Government of Aragon, which establishes urgent measures to repair the damage caused and the losses caused in the territory of Aragon as a consequence of the torrential rains of June 13 and 14, 2025. 2. This aid is covered by the provisions of Article 37, relating to aid intended to compensate for damage caused by natural disasters in the agricultural sector, of Commission Regulation (EU) No. 2022/2472, of December 14, 2022, declaring certain categories of aid in the agricultural and forestry sectors and in rural areas compatible with the internal market in application of Articles 107 and 108 of the Treaty on the Functioning of the European Union. 3. The approval of the call for aid is also the object of this order. 4. The territorial scope of application of this order will be that established in article 2 of Decree-Law 3/2025, of June 20. Second. – Requirements of the beneficiaries. 1. Beneficiaries may be the owners of agricultural holdings (agricultural or livestock) who meet, in addition to the provisions of article 11.3 of Law 38/2003, of November 28, General Subsidies, the following requirements at the final date of submission of applications: When the owner is a natural person: Be of legal age When the owner is a legal person or entity without legal personality: The condition of ownership: shared ownership, partnership agrarian transformation, cooperative, labor company, commercial company or civil society, whose partners and participation fee are clearly identified. Agricultural activity as the main social object. The status of all the partners as natural persons, of which at least half (50%) will meet the conditions required in the previous section for the farmer as a natural person and who, likewise, must hold more than fifty percent (50%) of the ownership in the capital or participation structure of the entity, except in the case of shared ownership in which the social capital is distributed at 50%. 2. Companies that are considered large companies in accordance with the provisions of Annex I to Regulation (EU) No. 702/2014, of the Commission, of June 25, 2014, may not be beneficiaries of this aid. 3. To receive the compensation contemplated in article 4, it will be necessary for the beneficiary to have a valid insurance policy covered by the Combined Agricultural Insurance Plan in force for the affected productions, being Excluding corpse removal and destruction policies. 4. To receive the subsidies contemplated in article 5, it will be necessary for the infrastructure or facility to be insured, provided that it is insurable. To proceed with the replacement of infrastructure, both insurable and non-insurable, you must have the relevant administrative permits. 5. Those who fall under any of the causes of prohibition provided for in Article 13 of Law 38/2003, of November 17, General Subsidies, or are subject to a pending recovery order following a previous decision of the European Commission that has declared aid illegal and incompatible with the internal market, will not be able to obtain the status of beneficiaries. Third. - Regulatory bases. DECREE-LAW 3/2025, of June 20, of the Government of Aragon, which establishes urgent measures to repair the damage caused and the losses produced in the territory of Aragon as a result of the torrential rains of June 13 and 14, 2025 (Extraordinary BOA Number 1 of June 20). Room. - Application submission deadline. The deadline for submitting applications for subsidies will end on July 31, 2025. Fifth. - Conditions for submitting applications. 1. Interested persons or their legal representatives will prepare and register their request and the documentation related to it as indicated in article 11.2 of this order.
