Official description of the call

In accordance with the provisions of articles 17.3.b) and 20.8.a) of Law 38/2003, of November 17, General Subsidies, the extract of the call is published, the full text of which can be consulted in the National Subsidies Database (https://www.pap.hacienda.gob.es/bdnstrans/GE/es/inicio) and on the website of the Community of Madrid (http://www.madrid.org). First Beneficiaries 1. Natural or legal persons who carry out economic activities linked to the tourism sector in the Community of Madrid may obtain the status of beneficiaries, provided that the following requirements are met, which must be maintained from the submission of the application until the formal justification of the aid granted: a) They carry out an economic activity by which they offer goods or services on the market in real estate, infrastructure or facilities that are located in the territory of the Community of Madrid. b) That they are registered in the Census of Entrepreneurs, Professionals and Withholders of the State Tax Administration Agency. c) That your activity is classified under one of the National Classification of Economic Activities (CNAE) codes listed in the third section of the Order. 2. The following may not be beneficiaries of this aid: a) Those who do not comply with the provisions of article 13.2.g) of Law 38/2003, of November 17. b) Companies that are in a crisis situation, in accordance with the definition made for these purposes in EU Regulation 651/2014, of June 17, 2014, and in the Community guidelines on state aid for the rescue and restructuring of non-financial companies in crisis (Communication from the Commission, 2014/C 249/01, of July 31, 2014). c) Companies that are subject to a pending recovery order on any aid or subsidy that had been previously granted to them, either because aid has been declared illegal and incompatible with the internal market, or due to any type of non-compliance with the obligations attributed to them in the concession. d) City councils, public companies, foundations or public organizations dependent on it with legal personality. e) Groups of natural or legal persons that lack their own legal personality, such as communities of property or any other type of economic unit or separate assets. Second Object, purpose of the subsidies and eligible actions 1. Object: This call develops the requirements established by Order 1320/2024, with regard to aid for the financing of investment projects to improve the energy efficiency of tourism companies under the Recovery, Transformation and Resilience Plan of Spain, approved by Agreement of the Council of Ministers of April 27, 2021. The subsidies will be granted under the non-competitive competition. 2. Purpose of the subsidies. The purpose of this aid is to contribute to the financing of energy efficiency and circular economy projects, consisting of the replacement of existing appliances with more efficient ones, in accordance with the "modernization and competitiveness of the tourism sector" section of the Recovery, Transformation and Resilience Plan (C14.I4, Line of Action 2), in buildings in the region intended for tourist establishments and facilities and those in which other business or professional economic activities linked to the tourism sector are carried out, with the double objective of the achievement of more sustainable management and the reduction of the environmental impacts of tourism activity. 3. Typologies and eligible actions. 1. Eligible actions must fall within the following typology and comply with the specific requirements established in the public call for subsidies: Replacement of household appliances with more efficient ones. 2. The actions will necessarily be framed in sections 024, 024 bis and 044 of Regulation (EU) 2021/241 of the European Parliament and of the Council, of February 12, 2021, which establishes the Recovery and Resilience Mechanism. 3.
