Official description of the call
In accordance with the provisions of articles 17.3.b and 20.8.a of Law 38/2003, of November 17, general on subsidies, the extract of the Call is published, the full text of which can be consulted in the National Subsidies Database (http://www.pap.minhap.gob.es/bdnstrans/index), and on the website of the Institut Valencià de Finances (http://www.ivf.gva.es and http://www.prestamos.ivf.es) First. - Beneficiaries 1. Companies that meet the following requirements may be beneficiaries of the subsidized financing under this call: a) They will have at least one establishment or branch located in the Valencian Community. b) At the time of application, you must prove a minimum seniority of two years and have at least one corporate employee or self-employed worker. c) It will have all the licenses, authorizations and permits necessary to carry out its activity and comply with applicable national and community regulations. d) You will prove that you are up to date with compliance with tax obligations before the State and the Generalitat, as well as obligations before Social Security. Debts that are deferred, divided or whose execution is suspended are considered to meet the requirement of being up to date with the obligations. e) It will not be subject to a pending recovery order, following a previous decision of the European Commission that has declared aid illegal and incompatible with the common market. f) You will not be found in any of the following circumstances provided for in article 13 of Law 38/2003, of November 17, General Subsidies (hereinafter, LGS): i. Having been sentenced by a final sentence to the penalty of loss of the possibility of obtaining subsidies or public aid or for crimes of prevarication, bribery, embezzlement of public funds, influence peddling, fraud and illegal exactions or urban planning crimes. ii. Having requested the declaration of voluntary bankruptcy, having been declared insolvent in any procedure, being declared bankrupt, unless an agreement has become effective in this case, being subject to judicial intervention or having been disqualified in accordance with Royal Legislative Decree 1/2020, of May 5, which approves the consolidated text of the Bankruptcy Law, without the period of disqualification established in the bankruptcy qualification ruling having concluded. iii. Having given rise, for a reason for which he had been declared guilty, to the final termination of any contract entered into with the Administration. iv. The administrators of commercial companies or those natural persons who hold the legal representation of other legal entities are involved in any of the cases of Law 3/2015, of March 30, regulating the exercise of the high office of the General Administration of the State, of Law 53/1984, of December 26, on incompatibilities of Personnel in the Service of Public Administrations, or in the case of any of the elective positions. regulated in Organic Law 5/1985, of June 19, of the General Electoral Regime, in the terms established therein or in the regional regulations that regulate these matters. v. Have tax residence in a country or territory legally qualified as a tax haven. vi. Not being up to date with payment of obligations for reimbursement of subsidies in the terms determined by regulation. vii. Having been sanctioned by a final resolution with the loss of the possibility of obtaining subsidies in accordance with the laws that establish it. viii. The groups provided for in article 11.3 of the LGS, second paragraph, will not be able to access the status of beneficiaries when any of the above prohibitions apply to any of their members. ix. The prohibitions on obtaining subsidies will also affect those companies that, due to the people who govern them or other circumstances, can be presumed to be a continuation or that derive, by transformation, merger or succession, from other companies in which they have participated. 2. The beneficiary cannot be affected by any of the following situations: a. Incidents with financial entities in CIRBE and/or in default records. b. Negative own funds as of the date of the last accounting closing (unless the applicant can prove that the aforementioned situation
