Law 3/2015, of June 18, on Housing, regulates in its Chapter IX, a series of legal guarantees for the adequate use of the habitability conditions and the social function of housing, establishing within the framework of its powers measures aimed at guaranteeing the social function of housing, among which is preventing its vacancy. It is based on the legal consideration provided for in article 4 of the aforementioned Law of understanding the situation or state of vacancy of the housing as a failure to comply with the social function that defines and characterizes housing, which is mandatory for both people who own housing and those who hold a legal title that allows the possession or enjoyment of a home. To promote compliance with the social function of housing through its effective occupation for residential use, the Housing Law regulates various mechanisms, including the declaration of uninhabited housing, developed in Decree 149/2021, of June 8, on uninhabited housing and measures for compliance with the social function of housing.
