RESOLUTION OF THE DIRECTOR GENERAL OF THE ICA CALLING FOR THE GRANTING OF FINANCIAL AID, UNDER A REGIME OF COMPETITIVE CONCURRENCY, FOR THE PROMOTION AND MARKETING OF FILM PRODUCTIONS FROM PRODUCTION COMPANIES IN THE REGION OF MURCIA

Official description of the call
First.- Beneficiaries Private legal entities that have tax residence in the Region of Murcia, that have produced an audiovisual work of those included in article 1.2 and that, in compliance with the requirements and conditions established in this Resolution, intend to carry out promotion and marketing actions in order to disseminate, promote or market the same, may benefit from the aid contemplated in this call. Likewise, the work being promoted may be the result of a co-production, as long as the applicant production company, resident in the Region, holds the majority participation in the co-production, with the majority percentage not being required in the case of entirely regional co-productions. The applicant will exercise sufficient representation capacity, in the terms established in Title I of the Law of Common Administrative Procedure of Public Administrations, to act in the name and on behalf of the co-production before the ICA, and the percentage and rights in the co-production must be accredited by means of an official or private document. The following requirements must be met at the time of submission of the application and kept in force during all phases of the project and its justification, as well as the statute of limitations for reimbursement and infringements that, where applicable, are provided for in articles 39 and 65 of Law 38/2003, of November 17: Tax domicile of the applicant in the territory of the Region of Murcia. Registration in the heading of the Economic Activities Tax (I.A.E.) 961.1 and in the Administrative Registry of Cinematographic Companies of the Institute of Cinematography and Audiovisual Arts. Be up to date with your fiscal and tax obligations, as well as with Social Security and subsidies. The works being promoted must have at the time of application the certificate of Spanish nationality, as well as the certificate of qualification of works for cinematographic exploitation or films and audiovisual works for non-cinematic commercial exploitation, which must have been obtained during the years 2022 or 2023 issued by the Institute of Cinematography and Audiovisual Arts. That they are audiovisual projects intended for exhibition in commercial/professional movie theaters or on-demand television platforms (Video On Demand (VOD)). Not having been subject to the sanction consisting of the loss of the possibility of obtaining subsidies for non-compliance with any regulation, and especially in matters of equality between women and men in accordance with the provisions of Royal Legislative Decree 5/2000, of August 4, which approves the consolidated text of the Law on Infractions and Sanctions in the Social Order. Comply with the obligation regarding the quota for reserving jobs for people with disabilities, if applicable, as established in Royal Legislative Decree 1/2013, of November 29, which approves the Revised Text of the General Law on the rights of people with disabilities and their social inclusion. Comply with the rest of the obligations established by state and regional legislation regarding subsidies. Excluded are public entities or companies or any type of public law entity, non-profit entities, individuals or groups of these, those that carry out associative or professional activities (associations, policies, unions, professional associations, etc.) or projects produced by television operators or other communication service providers in accordance with the second section of article 19 of Law 55/2007, of December 28, on Cinema, as well as any other legal figure on the that any of the subjects mentioned in this paragraph may exercise a dominant influence, whether for reasons of ownership, financial participation or by having the power to condition, in some way, the decision-making of the respective administrative or management bodies. Likewise, projects or works financed entirely or mostly by public administrations are excluded; or that have essentially advertising content and political propaganda; or that they had obtained the “X” film rating; or that violate or do not respect the norm
