In accordance with the provisions of articles 17.3.b and 20.8.a of Law 38/2003, of November 17, general on subsidies, the extract of the Call is published, the full text of which can be consulted in the National Subsidies Database (http://www.pap.minhap.gob.es/bdnstrans/index), and on the website of the Institut Valencià de Finances (http://www.ivf.gva.es and http://www.prestamos.ivf.es) First.- Beneficiaries 1. The applicant must provide a concerted service or have received a subsidy from the Generalitat Valenciana for the 2024 financial year in one of the modalities described in the previous article. 2. The beneficiary will be able to have all the licenses, authorizations and permits necessary for the execution of the project and comply with the applicable national and community regulations and, in particular, in matters of competition, public sector contracting and the environment. 3. The beneficiary will prove that he or she is up to date with compliance with tax obligations before the State and the Generalitat, as well as obligations before Social Security. 4. The beneficiary will not be subject to a pending recovery order, following a decision by the European Commission declaring aid illegal and incompatible with the common market. 5. The beneficiary will not be found in any of the following circumstances provided for in article 13 of Law 38/2003, of November 17, General Subsidies (LGS): a) Having been sentenced by a final sentence to the penalty of losing the possibility of obtaining subsidies or public aid or for crimes of prevarication, bribery, embezzlement of public funds, influence peddling, fraud and illegal exactions or urban planning crimes. b) Having requested the declaration of voluntary bankruptcy, having been declared insolvent in any procedure, being declared in bankruptcy, unless an agreement has become effective in this case, being subject to judicial intervention or having been disqualified in accordance with Royal Legislative Decree 1/2020, of May 5, which approves the consolidated text of the Bankruptcy Law, without the period of disqualification established in the bankruptcy qualification ruling having concluded. c) Have given rise, for reasons for which they have been declared guilty, to the final termination of any contract entered into with the Administration. d) The natural person, the administrators of commercial companies or those who hold the legal representation of other legal entities, are involved in any of the cases of Law 3/2015, of March 30, regulating the exercise of the high position of the General Administration of the State, of Law 53/1984, of December 26, on incompatibilities of Personnel in the Service of Public Administrations, or it is any of the positions electives regulated in Organic Law 5/1985, of June 19, of the General Electoral Regime, in the terms established therein or in the regional regulations that regulate these matters. e) Have tax residence in a country or territory legally qualified as a tax haven. f) Not being up to date with payment of obligations for reimbursement of subsidies in the terms determined by regulation. g) Having been sanctioned by a final resolution with the loss of the possibility of obtaining subsidies in accordance with the laws that establish it. h) The groups provided for in article 11.3 of the LGS, second paragraph, will not be able to access the status of beneficiaries when any of the previous prohibitions apply to any of their members. i) The prohibitions on obtaining subsidies will also affect those companies that, due to the people who govern them or other circumstances, can be presumed to be a continuation or that derive, by transformation, merger or succession, from other companies in which they have participated. 6. The beneficiary is not subject to collective insolvency proceedings nor does he meet the requirements to be subject to collective insolvency proceedings at the request of his creditors under national law. 7. Compliance with the requirements of this article must be accredited by signing the Responsible Declaration. The fact of presenting this Responsible Declaration will authorize the IVF to make, at any time, electronically or by other means
